RoadTrucker's TOS (Terms of Service)

1. Terms

By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law.

2. Use License

  1. Permission is granted to temporarily download one copy of the materials (information or software) on RoadTrucker Inc's web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
    1. modify or copy the materials;
    2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
    3. attempt to decompile or reverse engineer any software or apps contained on RoadTrucker Inc's web site;
    4. remove any copyright or other proprietary notations from the materials; or
    5. transfer the materials to another person or "mirror" the materials on any other server.
  2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by RoadTrucker Inc at any time. 3. Disclaimer

  1. The materials on RoadTrucker Inc's web site are provided "as is". RoadTrucker Inc makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, RoadTrucker Inc does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.

4a. Risk of Loss (No Signature Required)

All items purchased from RoadTrucker Inc are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our or our agent's delivery to the carrier.

4b. Risk of Loss (Signature Required)

RoadTrucker and/or their distributors insure purchases during the time it takes in transit until it is delivered to your specified shipping address. We require a delivery Signature for purchased items over $300 and for items that we consider to be high risk for possible theft, for goods delivered, at which point, responsibility for your purchase is passed to you. If you specified a recipient, other than yourself, for delivery (for example as a gift), then you accept, that evidence of a Signature by them (or at that delivery address), is evidence of delivery and fulfillment by RoadTrucker and/or one of its distributors, and the transfer of responsibility in the same way.

When placing an order, the Signature Requirement is set by default for all products with the number “5” in the leading 3d position of our product ID. Example: ##5######. Place the item in the cart to see our product ID at the end of the description.

Please note, that if the Signature Requirement is not acceptable to you, it is your responsibility to let RoadTrucker know, either before the order is placed or in the Customer Message box at the time of the order, that you do not want to Sign for your package. RoadTrucker will make a determination, as to whether to ship your order without Signature or cancel the order. Under no circumstances will RoadTrucker be responsible for cost incurred because of your failure to Sign for the Package.


5. Returns, Refunds and Title

RoadTrucker Inc does not take title to returned items until the item arrives at our or our agent's fulfillment center. At our discretion, a refund may be issued without requiring a return. In this situation, RoadTrucker Inc does not take title to the refunded item. For more information about our returns and refunds, please see our Returns Policy.


6. Product Descriptions

RoadTrucker Inc. attempts to be as accurate as possible. However, RoadTrucker Inc. does not warrant that product descriptions or other content of any RoadTrucker Inc. Service, is accurate, complete, reliable, current, or error-free. In particular, Manuals (including any that come with the product); as well as Videos; and Text or Advertising on the box or package; tend to get out of date and should only be used as a general guide to the product. 

If any product offered by RoadTrucker Inc., is not as described, your sole remedy is to return it in unused condition with all parts and packaging for a full refund. You may request a shipping label within 7 days of purchase or 3 days of delivery, but no shipping refunds will be granted.

At entirely RoadTrucker's discretion, we may or may not supply you with a Return shipping label. Under no circumstances will we supply a Return Shipping label for out of country sales. Out of country sales are only done as a courtesy to the customer and those customer take full responsibility for Returning any item for any reason.

7. Out of Country Purchases

“Out of Country” orders usually incur additional shipping cost when shipped outside the United States. When applicable, RoadTrucker will send a none binding Invoice to the customer for the difference in shipping, that is not covered in the sales Order itself. Customer has the choice to pay the additional shipping or cancel the order and be refunded in full.

Note: Customer is responsible for “In Country” Taxes, Custom Duties, Foreign Transaction and Brokerage Fees, and other charges, that may also apply, depending on the country of delivery

8. Pricing

Despite our best efforts, a small number of the items in our product offerings may be mispriced. If the correct price of an item sold by RoadTrucker Inc. is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or refund and cancel your order and notify you of such cancellation. Other merchants may follow different policies in the event of a mispriced item.

9. Limitations

In no event shall RoadTrucker Inc or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on RoadTrucker Inc's Internet site, even if RoadTrucker Inc or a RoadTrucker Inc authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.


10. Revisions and Errata

The materials appearing on RoadTrucker Inc's web site could include technical, typographical, photographic or pricing errors. RoadTrucker Inc does not warrant that any of the materials on its web site are accurate, complete, or current. RoadTrucker Inc may make changes to the materials contained on its web site at any time without notice. RoadTrucker Inc does not, however, make any commitment to update the materials.

RoadTrucker Inc has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by RoadTrucker Inc of the site. Use of any such linked web site is at the user's own risk.

12. Site Terms of Use Modifications

RoadTrucker Inc may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.


13. Governing Law

Any claim relating to RoadTrucker Inc's web site shall be governed by the laws of the State of North Carolina without regard to its conflict of law provisions.
